Description
This unit of competency specifies the skills and knowledge required to research, interpret and apply building accessibility legislation when assessing the accessibility of large-scale buildings. Large-scale buildings are buildings of any class as defined in the National Construction Code (NCC) and which exceed 2,000 square metres in floor area. The unit includes interpreting and evaluating the Australian common law system and various sources of law applicable to the accessibility of large-scale building developments and analysing and applying professional codes of practice for the assessment and inspection of buildings.This unit is for individuals who are self-directed and have substantial depth of knowledge and skills to make independent judgements in the provision of access consulting services.No licensing, legislative or certification requirements apply to this unit at the time of publication.

1 Research and analyse the Australian administrative legal system.
  • 1.1 Interpret and document the differences between common law, statute law, delegated legislation and local government law.
  • 1.2 Research and analyse civil law and examples of civil action relevant to building accessibility of large-scale buildings.
  • 1.3 Research and analyse administrative law relevant to building accessibility.
2 Evaluate administrative law applicable to building accessibility.
  • 2.1 Evaluate and document individual elements of judicial review legislation.
  • 2.2 Identify and evaluate natural justice issues related to decision making through the building control process.
3 Identify and analyse the procedures and benefits of enforcing the law.
  • 3.1 Research, analyse and document the legislative benefits and examples of building accessibility enforcement.
  • 3.2 Identify and record major regulatory enforcement strategies for building accessibility.
  • 3.3 Identify, analyse and document building certifier powers of entry and legal considerations for obtaining warrants.
  • 3.4 Identify, gather and document types of evidence required to investigate and prove breaches of legislation.
  • 3.5 Identify processes for addressing regulatory non-compliances and prepare related working documentation in a format suitable for review by a building certifier.
4 Analyse the impact of any other legislation on state and territory legislation regarding building and development control and access.
  • 4.1 Analyse and document the implications of Commonwealth access legislation on state and territory building and development control legislation.

5 Analyse the professional code of practice applicable to the assessment of accessible large-scale buildings.
